Terms of Service & User Agreement

By creating an account, joining or running a pool, or otherwise using FantasyDailies ("the Service"), you agree to these Terms. If you do not agree, do not use the Service.

1.What FantasyDailies Is

FantasyDailies is a software platform that provides tools for organizing and tracking friendly and office pools and contests (survivor, gauntlet, pick'em, squares, and similar), plus sports information and analytics. We provide the tools and tracking only. We do not run your pool, set odds, take positions against you, or act as a bookmaker, sportsbook, bank, or escrow agent.

2.Contests Are Peer-to-Peer (P2P)

Every contest is P2P. Any buy-in, prize, payout, or buyback is arranged and settled directly among the participants and the pool commissioner. FantasyDailies is not a party to any contest, is not responsible for collecting or distributing any funds, and does not guarantee that any participant will pay, pay out, or honor any arrangement. Money disputes are strictly between the participants.

3.Entertainment & Your Responsibility

The Service is provided for entertainment purposes. You are solely responsible for ensuring that your participation in any pool or contest is legal where you live and that you comply with all applicable laws. You represent that you are of legal age in your jurisdiction. If a contest is not permitted where you are, do not participate.

4.Commissioner Responsibilities

If you create or run a pool ("commissioner"), you are responsible for your pool's rules, collecting and paying out any money (P2P), verifying your participants, resolving disputes among your members, and complying with applicable laws. The auto-generated rulebook is a convenience based on the settings you choose; you are responsible for confirming it reflects your intent.

5.Results Come From the Games, Not From Us or Admins

Contest results are determined by real, publicly reported game outcomes. Neither FantasyDailies nor any commissioner can override a game result. We do not warrant that scores, schedules, injury data, odds, or any information on the Service are accurate, complete, or timely, and you should not rely on them for wagering or any financial decision.

6.Service Provided "AS IS" — No Guarantee of Uptime or Data

The Service is provided "as is" and "as available," without warranties of any kind, express or implied. We do not guarantee that the Service will be uninterrupted, secure, error-free, or available at any time; that data (including pools, picks, standings, messages, or history) will be preserved, backed up, or recoverable; or that any defect will be corrected. The Service may be modified, suspended, or discontinued at any time without notice. You use the Service at your own risk.

7.Limitation of Liability

To the fullest extent permitted by law, FantasyDailies and its owner, operators, and affiliates are not liable for any indirect, incidental, special, consequential, or punitive damages, or for any loss of money, winnings, data, picks, profits, goodwill, or opportunity, arising from or related to your use of (or inability to use) the Service — including outages, downtime, server failure, data loss, bugs, missed picks or deadlines, incorrect results or information, or the acts of any participant or commissioner. To the extent any liability is not disclaimable, our total aggregate liability to you is limited to the greater of the amount you paid us for the Service (which for most users is $0) or $50.

8.Indemnification

You agree to indemnify and hold harmless FantasyDailies and its owner and operators from any claims, losses, liabilities, and expenses (including reasonable legal fees) arising from your use of the Service, your pools or contests, your handling of money, or your violation of these Terms or any law.

9.Accounts & Conduct

You are responsible for activity under your account. Don't cheat, harass, post unlawful or abusive content, attempt to break or overload the Service, or misuse other members' information. We may suspend or remove accounts, pools, or content at our discretion.

10.Taxes Are Your Responsibility

Depending on your situation (especially commissioners who pay out winnings), you may need one of these official IRS forms. We link to the always-current versions on IRS.gov — we don't host copies, so you always get the correct one:

• Form W-9 — Request for Taxpayer ID. Collected from a payee and kept for your records; it is not filed with the IRS.
• Form 1099-NEC — to report nonemployee compensation of $600 or more that you paid someone.
• Form 1099-K — payment-processor reporting (context for app/card payments).
• Reporting payments to independent contractors — IRS overview.

11.Changes

We may update these Terms at any time. Continued use after changes means you accept the updated Terms. Material changes will be reflected by the "last updated" date above.
